Divorce and naturalization
Dear Allan,
Thanks in advance for answering this question. My situation is as follows: Married in March of 2004. received permanent Green Card 2 years and 6 months after. Separated from my husband 2 months later. Filing for divorce now, have been married for over 5 years. I need to establish the date of separation in order to file for divorce. I am concerned whether the date of separation being so close to the date of receiving Green Card would affect my ability to become a US citizen. If it will raise any questions with USCIS regarding the marriage being bona fide. Your response is much appreciated. |

Re: Divorce and naturalization
Ideally, the date of separation should be after you received your green card. It seems like it is. You will be eligible to apply for naturalization 57 months after the date you received your green card.
If you want to be sure that you will not have any problem about the bona fides of your marriage collect all the documents that show you were living together as husband and wife. Good Luck, ALLAN SAMSON |
