Dear Allan,

Could you please answer my question?

I am a Russian citizen.
I am going to get married to an US citizen, but I have to divorce in Russia first.
I don't want to go back to do that and my wife is agree to divorce, but she said she needs a document from me saying that I am willing to get divorced. She said it would be faster if I could send her one.

What kind of document do I need in this case?
Do I need a help of a lawyer with it?

This is a question I cannot answer because I am not licensed to practice law in Russia. If there is a potential problem you should ask a Russian attorney or have a friend ask a Russian attorney about any potential problems which could arise -- particularly if children or property are involved.

I do know that you can obtain a divorce in the United States (in the State where you live) even though your wife is not in the United States.

Remember, your divorce must be final (whether it is done in Russia or in the US) before you can marry again.

Do I have to be ligal to get divorced in US? Does it do any changes to the process of divorce and mariage?
My visa has expired long time ago (more then 180 days).

You do not have to be in legal status in the US but you must fulfill the residency requirements for the state and county in which you live. Good Luck, ALLAN SAMSON
