Dear Sir! I am Ukrainian Fulbright scholar in the USA.
I have J-i visa and will stay here till end of May.
This visa does not give to me the opportunity to apply
for 2 years. I must come back to Ukraine and stay
there for two yrears but I have American friend here
who is going to marry me. He is about 80 years old
and I am 48 years old. He can not go to Ukraine and
stay there for two years . It is dangerous for his
health. Can I apply for a waiver and stay here if I
marry him. Do I have a chance to become a waiver.
Soon I will have my Social security number. Please,
answer what do you think about our situation. If I
come back to Ukraine and will apply in two years I am
not sure that I will come back. INS can be sucpicious
about the age difference. And my friend is not young.
Nobody knows what will be with him and with me in two
years.

I wold say your chances for a waiver are not good. Your husband's age is not a sufficient reason to be granted a waiver. Even if the waiver problem did not exist, a marriage between a 48 year-old and a 80 year-old would certainly raise suspicion at the time of your interview. Good Luck, ALLAN SAMSON
