Married Mother

My mother has been married to an american for a year now and is in the process of getting a green card. I am currently on F-1 finishing school here. What complications can I face if I decide to go back to Russia and then to get a new visa? Same question for H-1 holders.

If you return to Russia and reapply for another F-1 and they ask you if you have any relative in the US and you tell them that your mother has a green card it may be more difficult. You should say that your mother has not petitioned for a green card for you. They are concerned that you may come back to the US and wait and wait and wait. The fact that your mother has not petitioned for you is better than if she had petitioned for you but it is not as good as if your mother did not have a green card herself. Good Luck, ALLAN SAMSON
