advance parole

Hi there,
I was just woundering, if I have an advenced parole now and I was in the country illegally before with an expired visa would I be able to re-enter the country when I go to visit my parents this summer. If not, what are the consequances(can INS send me back the same day or what).

If you have been illegal less than 180 days you should not have any problem. If more than 180 days it will be a 3 year penalty. If more than 360 days, a 10 year penalty. If you use your advance parole you will probably be allowed bwck into the US even if you have been illegal more than 180 days. The problem will come at your interview when you will be told that they cannot adjust your status to a green card because you were illegal for more than 180 days. They will then say you must go back to your home country to get the green card after an interview. It is there you will be hit by the 3 year or 10 year penalty. Good Luck, ALLAN SAMSON
