Dear Allan,
I am going to Russia to visit my parents soon. I have approved H1B petition but I still need visa in my passport.
I am 99% sure that I will get the visa because all documents are OK, but everything may happens in Russia and there is still small possibility that they will not give me the visa (for example because the visa limit for this year may be reached or some other reason).
On the other hand I have not expired F1 visa in my passport and employment authorization card for one year of student optional practical training that is not expired also. So, my question is: if US consul in Ekaterenburg (Russia) will reject my H1B visa application does it mean that my H1B status would be canceled and I returne legally to F1 OPT student status with employment authorization? Can I in this case return to US with my F1 visa and continue to work with this OPT authorization?
Thank you
Sergey
