Dear Allan Samson:

I had entered this country by way of a marriage to an American man. I have been living in-country since August , 2001, approximately 6-months; I am currently residing in the USA on a K-1 Visa and have been issued a Social Security Number.

I have been divorced as of January , 2002, from the American man by whom I had entered this country with and since that time, have fallen in-love with another wonderful American man. We are engaged and will be married on April , 2002.

Here is my problem.
As I will be getting re-married very soon, will my status change during this interim period? That is to say, will I have to leave the country; then, come back to marry my fiancée?

If chances are good that I must leave, what steps can be taken so this can be avoided?
It is very expensive to travel to Ukraine and then back again. This would cause both my fiancée and me extreme financial hardship; not to mention the personal suffering and separation, which must be endured by both our families.

Please Advise.

Since you married the man from whom you received a K-1 visa, you can remain in the US and adjust your status here. If you had not married the man from whom you received the K-1 you would have to return to your home country. Good Lucjk, ALLAN SAMSON

My understanding is that the previous man that you were married to can stop all of your paperwork with the INS. All he has to do is write them and your adjustment status will be stopped. Additonally, you might want to discover if you are in this country legally. If you file with a new husaband they may deport you.
