Hello!
My name is Greg.
I am a US citizen. I married a Russian Citizen and applied for her to receive permanent resident’s status.
Later I learned that the marriage was a fraud - sort of “immigration vehicle” for my ex-wife.
I got a divorce, canceled the application and informed the INS about fraudulent nature of the marriage prior of joint interview. As far as I know, my ex-wife in order to stay in US claimed the physical abuse but was rejected. Her attorney is appealing this INS decision. What is her chance to stay here in US based on our marriage? Can she stay if she marry someone else or through the employment? How long her deportation would take?

She can attempt to remain here throuogh a new marriage or through employment. In order for her to be permanentlyh barred from the US, the INS must first determine that her marriage to you was fraudulent and intended only in order to obtain a green card. It is not easy for INS to prove this because the burden of proof is on the Government at a removal hearing in front of the Judge. ALLAN SAMSON

Greg,

How did you find out that your marriage was for immigration purposes and not love? Did you hire an investigator or was it a gut feeling complied by inconsistent
behaviors on the part of your ex-wife?

Thanks
