Ануляция брака!! Если кто знает!!

Помогите!!!

Получила уведомление об ануляции брака от моего мужа. Мы оформляли брак в Огайо. Прожили 5-ть летб потом я уехала в Калифорнию. Почему он хочет ануляциюю Что за этим скрывается. Ведь фактически это значит что брак никогда не существовал. Он утверждает что это был фрод с моей стороны и что я вообще ужасная, Еще что бы заплатила за все его расходы.

Если брак никогда не существовал тогда как это отразится на наших налогах, мы платили как замужние меньше?

Я уже гражданка почти 1,5 года и получила этот статус по замужеству, мемя что могут лешить гражданства?

Пожалуйста подскажите что делать?

She is not divorced. She got a notice that her husband filed for annulment of their marriage based on fraud.

But I dont think you should worry. You are a citizen now, right? For a year and a half. I am not sure that INS can revoke your citizenship if your husband claims your basically fooled him into marrying him because of the documents. I think they can still revoke a green card if they believe him. I am not sure. But you are a citizen now.

I just know that courts dont like annulment cases, and besides they are hard to prove. So he would really have to apply some serious effort to prove the fact of fraud. Plus you say you were married for 5 years and filed taxes together and everything.

Besides, as Mr.Samson once mentioned here before, the marriage can't be annulled without the other spouse's consent. So he can't just get an annulment without you, I assume.

What do you think, Mr.Samson? Can INS revoke her citizenship if her husband filed for annulment based on marriage fraud?

Sea-Star, why didn't you just file for divorce when you left him and went to California? The problem of annulment would be non-existent now.

I’m not scaring her, just giving an FYI. I also heard of cases were they have taken it away if the marriage was a complete fraud.

Is he Catholic? If he is and gets divorced, he will never be able to get married again as a Catholic. Only if the marriage is annuled will he be able to remarry properly according to his traditions. (This may apply to some other religions as well.) BTW, this is really not an immigration question. I will be moving it to the Help! forum, instead.

Nope, "Помогите!" forum is what I meant... The question was not in English, it was not addresed to our lawyers and I don't see why it has to do anything with Immigration - it is so far fetched!

Courts that deal with civil matters such as marriage are quite separate from Immigration.

Fraud is a criminal matter that would have to first be proven beyond reasonable doubt. Then "INS" would have to be notified, which notification is not even automatic, from what I understand. Only then they would be able to start their proceedings to strip away citizenship (based on fraudelant application) and deportation proceedings...

In this lady's case, two lawyers are usualy retained...
Since we have one here, this can be best answered by a pro, not us.
