I got a speeding ticket a couple of days ago late at night from a cop (Arapahoe County) who was obviously under the influence. I was going I-70 East, slowing down for my exit. This yahoo cop was going full speed West on the highway, crossed the meridian, stopped me and gave me a ticket for going 96 in a 75 mph zone. He got my age, distance from the exit and car registration information wrong, among other things. Now I have to go fight this stupid ticket.

For those familiar with Colorado Traffic Infraction statues and procedural law, I have two questions (others are encouraged to remain silent).

Three questions:
1. What form could I use for submitting my non-guilty plea by mail and where do I mail this form?
2. Can I ask for a trial by written declaration with the letter entering my non-guilty plea?
3. What is the discovery process? When and how can I ask for the evidence in this case, such as the radar reading, radar calibration information, officer's trainging credentials and High School/ GED certificate, as well as results of his drug test?
4. Is there an inexpensive lawyer that specializes in handling such cases in Colorado that you can reccomend and who can answer the above questions?

I ones got a ticket for carpool. $275, came to court wearing a tank top and denim shorts. The cop said he does not remember anything that happened that day, and the let me go.

A Young woman was pulled over for speeding.

A Colorado State Trooper walked to her car window, flipping open his ticket book,

She said, "I bet you are going to sell me a ticket to the State Trooper's Ball.

"He replied, "Colorado State Troopers don't have balls."

There was a moment of silence.

He then closed his book, got back in his patrol car and left.

Actually four... :grin: (nu kto schitaet?)

1. Go to traffic court and submit the Request For Trial by Written Declaration.

2. Don't have to plea, if you're doing #1.

3. Save the hustle for your preparations for the Trial with the Officer (Only if your Written Declaration Trial is lost).

4. No. Any Lawyer to deal with this will cost you at least $3,000- (Not cost effective).

Summary: The Best thing since the sliced bread is the Trial by Written Declaration. You have a chance of Judge dismissing the case. You have the chance of actually reviewing thew cop's statment in the sanctuary of your home. Make sure that the VAST mjority of cops will screw something up doing that, so you have a case. Example: even writing simple ticket he made tons of mistakes. If you lost the Trial by Written declaration, you CAN actually go back to court and request a new trial with the officer. All info from the personal experience and conversations with the traffic lawyers. Good Luck, Jake!

These statues vary greatly from state to state. I know how to deal with these situation effectively in California.

There are law firms that specialize in traffic court and they charge a reasonable flat fee for dealing with the paperwork on your behalf.

In Florida the fee for such a service is something like $50, I hear. I have paid around $500 in San Francisco about 6 years ago. LA is a bit less expensive then San Francisco.

I want to know if anyone can answer my questions as they concern COLORADO. (It is one of the tougher states to prove your innocence in case of a traffic ticket.)

Может я чего-то не понимаю и скажу что-то совсем наивное, но насколько я представляю процесс, выглядит это так: по почте ничего не посылаешь, по телефону выясняешь (переносишь если неудобно) дату суда, в суде во время допроса полицейского просишь его рассказать о том дне, где он был, как ехал, как мерил, в каком состоянии находился, потом просишь объяснить как же так если он находился в здравом уме и трезвой памяти он столько ошибок на тикете наделал, и тогда же просишь предъявить свидетельства того, что радар отколиброван, офицер сертифицирован и т.д. Твоя задача - продемонстрировать reasonable doubt в объективности показаний полицейского, если он не имеет при себе доказательств - его проблема.

Сам я, впрочем, собирался здесь пойти в traffic court только однажды, да так и не дошел. Так что может что неправильно помню из того, что читал...
А ты сейчас здесь или в Калифорнии? В библиотеке книжки вроде есть...

Colorado (as most other states) allows you to enter your plea by mail thereby avoiding having to appear twice. Officials don't like for you to do this, as it wastes less of your time and makes it more worthwhile for you to fight frivolous tickets. In fact, they do not even have to notify you of your right to do enter the plea by mail and they don't! I think it is a disgrace to our legal system that the back of your Colorado traffic ticket implies that you can not do this, by not listing this as a possible course of action, while specifying all others. They do not even provide a contact phone number - at least California is decent enough to do that! Needless to say, I am outraged.

Получилось по почте-то? Расскажи, чем закончилось. Интересно ведь.
Кстати, недавно местные менты получили пачку Додж-Чаржеров для undercover chasing speeders over +20MPH, чем несказанно гордятся.
Так что смотрите все в оба (то есть в заднее зеркало) за черными и серыми чарджерами без ментовских опознавательных знаков. В основном они на I-25.
