Ударил меня сзади один придурок, дал иншуранс инфу. Приехал их чел, сделал эстимэйт, все как надо. Но денег не шлют. Я им звоню, чё, мол, за дела, а они мне так вежливо: мы вам не можем оплатить, так как наш иншурд, типа, не возвращает наши звонки. Мы, мол, типа, рады, но не можем платить, так как у нас нет пруф, что был аксидент.

Пришлось идти в Ди-эМ-Ви, файлать аксидент рипорт, теперь это чмо получит пойты на рекорд за аварию... А ведь мог спокойно этого избежать, ведь страховка то у него есть. Я бы получил чек от иншуранса и все бы обошлось ему тихо-крыто...

You should not be making the calls, they need to be made by YOUR insurance with which you should have filed the same day. If you did not file, it is not too late, just fill them in on everything. If you have no insurance and the damage is for a good sum, get an attorney. If it is under $500, just file in small claims and have the guy served, then he will call his insurance back real quick.

The repair estimate is slightly under $1000-. My deductible on my insurance policy is $1,000-. So, my insurance company is out.
It is also too small for an attorney to get involved. I cannot take this guy to the Small Claims Court, because he lied to me about his address, that's why I filed an accident report with the DMV.

We are not talking about your insurance paying for the repair, we are talking about them negotiating on your behalf with the other insurance company. It is their job, which is what you pay them for.

And if you can file a DMV report you can file a small claims suit. The way that works is you actually trying to get money from the insurance company, but you can not sue them, you can only sue the guy.

It is still in your interest not to go to small claims, so have your insurance work for you like they are supposed to.

I don't have State Farm, but heard from industry specialists (like the one I consulted regarding the above) that they are excellent as far as taking care of their clients.

State Farm is expensive and the accident was not MY fault. But thank you for the offer. BTW, his insurance finally is handling my claim. Check's in the mail! :)
